Delhi High Court restrains T-series to use ‘Aashiqui’ in their film titles as it can cause public confusion and dilute the brand – Deets inside – Times of India



Aashiqui’ is now quite a brand when it comes to the way both the films of the franchise have done exceptionally well. The film starring Rahul Roy and Annu Agarwal which released in 1990, is still remembered for its narrative and exceptional music which remains in the hearts of the audience. Meanwhile, ‘Aashiqui 2′ had released in 2013, starring Shraddha Kapoor and Aditya Roy Kapur, and completely lived up to the success of the first part. Vishesh Films had registered trademarks for ‘Aashiqui’ and they were the OG co-producer of the film in 1990. Hence, the court has now passed a ruling in favour of Vishesh Films, after T-Series announced a film with a similar title.
Justice Sanjeev Narula stated that the use of these titles by T-Series could cause public confusion and dilute the ‘Aashiqui’ brand. Vishesh Films had registered trademarks for ‘Aashiqui’ and ‘Aashiqui Ke Liye’. Though, both these companies have collaborated together for the sequel. Hence, the court has now passed an order that both the production house cannot exploit the franchise or this title, without each other’s consent. This order has come after Vishesh Films argued that this could mislead the public.
Furthermore, the court said that ‘Aashiqui’ has become an integral part of a recognised film series and hence it’s important to maintain its distinctiveness. Vishesh Bhatt, Managing Director of Vishesh Films, expressed satisfaction with the judgement, stating it upholds their commitment to preserving their franchise’s legacy. The intention behind the court’s decision was also to avoid misleading consumers and dilute the brand.
Meanwhile, ‘Aashiqui 3’ had also been announced a while ago with Kartik Aaryan in the lead. Though, the search for the female lead continues and there’s been no recent update on this one!
