HYDERABAD: Telangana HC has refused to stay the caste survey schedule to begin on Nov 6, but directed state govt to constitute a dedicated backward classes commission within a week to conduct the exercise, reports SagarKumar Mutha.
Justice S Nanda posted the case for further hearing on Nov 21. Govt sources said they would go ahead with the survey from Nov 6 as the existing commission was dedicated to the survey, and also because HC did not stay the process. The first public hearing ahead of the door-to-door survey was already held on Oct 28 at Adilabad.
Justice Nanda passed the interim order on a petition filed by former MP R Krishnaiah, who contended that the state’s action in skipping the formation of a dedicated commission and preparing to get the survey done by the existing backward classes commission was contrary to Supreme Court directions.
Justice Nanda said the present commission, set up under Backward Commission Act-1993, could not be considered a dedicated commission for the purpose of determining political backwardness.
Advocate general A Sudarshan Reddy rushed to the court of Justice Nanda and urged her to review the order. “State govt had appointed the backward classes commission in Nov 2021. The GO issued says the commission shall act as the statutory commission for collecting the empirical data of the backward classes in the state. We have already complied with the direction of the Supreme Court,” the AG said.
